  1. Definitions
    1. Additional Terms and Conditions: the additional general terms and conditions applicable to the Workshops & Intensives organized by YogaFest Studio.
    2. General Terms and Conditions: the general terms and conditions used by YogaFest Studio, which have been published at the YogaFest Studio website, www.yogafeststudio.com.
    3. YogaFest Studio: YogaFest Studio BV has its official seat at Haarlemmerweg 4, 1014 BE, Amsterdam and is listed in the Trade Register under number 65960513.
    4. Drop-in class: a single yoga class at YogaFest Studio.
    5. 10 Class Pass: a pass for 10 yoga classes at YogaFest Studio.
    6. (Mysore) Monthly Membership: the membership for attending yoga classes at YogaFest Studio, issued or to be issued by YogaFest Studio and paid or to be paid by the Student.
    7. Private Class: a private yoga class at YogaFest Studio, for which the Student must make an appointment in advance.
    8. Student: a person who attends and/or wishes to attend private or group yoga classes/workshops at YogaFest Studio.
    9. Website: the website of YogaFest Studio: www.yogafeststudio.com
    10. Workshop: a yoga workshop given or to be given by YogaFest Studio.
    11. Intensive: a yoga intensive, as in multiple days/weekends given or to be given by YogaFest Studio.

 

  1. Scope of Application
    1. The General Terms and Conditions apply to any membership and, where applicable, to the Drop-in Class, 10 Class Plass, Private Classes as well as to all workshops, intensives & treatments.
    2. By participating in a yoga class of YogaFest Studio, the Student agrees to the applicability of these General Terms and Conditions.
    3. YogaFest Studio may from time to time amend these General Terms and Conditions. The most recent version of the Terms and Conditions is always the version that is applicable and is always available at the Website.

 

 

  1. Membership (with or without Ashtanga Mysore), Drop-in class, 10 Class Pass, and Private Class/Card 60 and 90

YogaFest Studio offers the following possibilities of attending yoga classes at YogaFest Studio.

  1. MONTHLY MEMBERSHIP (with or without Ashtanga Mysore)
    1. Membership entitles the member to an unlimited number of yoga classes during the term of the Membership.
    2. The minimum Membership term is three (3) consecutive calendar months. After the first three months, a Student’s Membership is tacitly converted into a continuing agreement for an indefinite period.
    3. The effective date of the term of any Membership is in agreement with the student.
    4. After the minimum term of three (3) months, a student’s Membership may be terminated every month. Cancellation of Membership must be communicated to YogaFest Studio in writing with one month notice. This may be done by sending an email to studio@yogafeststudio.com.
    5. A Student may use any Membership only in the event of payment by direct debit or creditcard (Visa/Mastercard)
    6. All Dutch Bank accounts and bank accounts from European SEPA countries are supported for the direct debit payment. Find below a list of the European SEPA countries: Åland Islands (FI), Austria (AT), Belgium (BE), Bulgaria (BG), Canary Islands (ES), Croatia (HR), Cyprus (CY), Czech Republic (CZ), Denmark (DK), Estonia (EE), Finland (FI), France (FR), French Guiana (GF), Germany (DE), Gibraltar (GI), Greece (GR), Guadeloupe (GP), Hungary (HU), Iceland (IS), Ireland (IE), Italy (IT), Latvia (LV), Liechtenstein (LI), Lithuania (LT), Luxembourg (LU), Malta (MT), Martinique (MT), Mayotte (YT), Monaco (MC), Netherlands (NL), Norway (NO), Poland (PL), Portugal (PT), Réunion (RE), Romania (RO), Saint Barthélemy (BL), Saint Martin (French part) (MF), Saint Pierre and Miquelon (PM), San Marino (SM), Slovakia (SK), Slovenia (SI), Spain (ES), Sweden (SE), Switzerland (CH), United Kingdom (GB).
    7. A student’s Membership commences when YogaFest Studio has received the membership fee from the Student.

 

  1. DROP-IN CLASS

A single class to be paid for in advance and to be followed at YogaFest Studio.

 

  1. INTRODUCTION CARD
    1. The Introduction Card entitles the holder to five (5) yoga classes and can be purchased only once by new students.
    2. The Special Introduction Offer is valid for 1 month.

 

  1. 10 CLASS PASS
    1. The 10 Class Pass entitles the holder to ten (10) yoga classes.
    2. The 10 Class Pass is valid for three (3) months after the date of purchase. The 10 classes must therefore be attended within three months of the date of purchase. After that period, this right lapses.

 

  1. PRIVATE CARD
  1. The “Private Card 60” and the “Private Card 90” entitle the holder to five private yoga classes of 60 and 90 minutes, respectively
  2. The “Private Card 60” and the “Private Card 90” are valid for 1 year from the date of purchase. This means that the five classes must be attended within three months of the date of purchase.
  3. There is a difference in price for a regular teacher and an experienced teacher.

 

  1. Payment and Price Changes
    1. All yoga classes organized by YogaFest Studio must be paid for before they are held. YogaFest Studio does not accept cash payments. Payments can be made by direct debit, PIN or Credit Card (Visa, Master Card).
    2. As a general rule, direct debits are made around the 1st of the month. In the case of non-payment, YogaFest Studio reserves the right to suspend the account of the relevant Student.
    3. YogaFest Studio reserves the right to change the prices. Any changes are announced in advance by placing statements on the Website, and/or by email. The currently applicable rates are always mentioned on the Website and are available for inspection at the reception desk of YogaFest Studio.
    4. Before a yoga class the Student must report to the reception desk of YogaFest Studio. After the YogaFest Studio employee has verified the registration and payment for the relevant yoga class, the Student receives a token. This token must be given to the relevant yoga teacher before the start of the yoga class.

 

  1. Reservations for Yoga Classes
    1. All Students must observe the house rules of YogaFest Studio:
      1. Please make sure you are clean and fresh when you attend the yoga class. The use of unscented deodorant is highly appreciated. In view of potential allergies of other Students, everyone is asked not to wear any perfume, aromatherapy oils or other scented products, and not to use any spray deodorant in the changing rooms.
      2. Wear clean yoga clothes in yoga classes, in which you can move easily.
      3. We advise not to eat later than two hours before the start of the yoga class and, in any case, not to do yoga on a full stomach.
      4. Please, do not wear shoes in the yoga studio’s.
      5. YogaFest Studio makes yoga mats available for use during yoga classes. After classes, a yoga mat must always be cleaned and put away by the Student who has used it.
      6. If you have any health conditions please make sure you have sufficient information from you doctor for safe management of that condition. In addition we require that you inform us of said conditions.

 

  1. YogaFest Studio reserves the right to deny Students who do not observe the house rules referred to in Clause 5.1 access to the YogaFest Studio premises and to terminate the Membership of the relevant Student without a refund of any membership fee paid already.
  2. The Student can at any time cancel a Yoga Class. An Early Cancel is any cancellation that is done before 5 hours of the start of the class. Within 5 hours before the class starts no refund will be given and this is notiftied as a Late Cancellation.

 

  1. Cancellation of classes
    1. In case of illness or an injury, the Student may cancel the workshop. A request for cancellation must be submitted to YogaFest Studio in writing and must be accompanied by a medical certificate. This termination may be sent by email to studio@yogafeststudio.com.
    2. YogaFest Studio reserves the right to cancel the Workshop if there are insufficient participants. In this case, the registration fee already paid by the Participants is refunded immediately.
    3. The Student can at any time cancel a Yoga Class. An Early Cancel is any cancellation that is done before 5 hours of the start of the class. Within 5 hours before the class starts no refund will be given and this is notiftied as a Late Cancellation.

 

 

  1. Schedule
    1. The current schedule is mentioned on the Website. YogaFest Studio reserves the right to change the schedule at any time.
    2. YogaFest Studio reserves the right to cancel a yoga class that has been scheduled or to change the yoga teacher mentioned in the schedule in the event of force majeure, including illness of the teacher. In this case there will be no refund of any Membership fee.
    3. YogaFest Studio is nearly always open but reserves the right to close its doors on public holidays or on other days.

 

  1. Early Termination of Membership in case of illness
    1. In the event of prolonged illness or an injury, the Student may terminate the Membership early. A request for early termination must be submitted to YogaFest Studio in writing and must be accompanied by a medical certificate. This termination may be sent by email to studio@yogafeststudio.com.

 

  1. Liability
    1. Attending yoga classes, workshops or intensives and leaving belongings in the changing rooms are at the Student’s own risk. YogaFest Studio accepts no liability whatsoever for physical injury, loss or damage relating to a Student’s attending yoga classes, workshops or intensives and leaving belongings in the changing rooms at YogaFest Studio. YogaFest provides lockers to store your belongings.
    2. YogaFest Studio works exclusively with certified yoga teachers and always ensures high-quality yoga classes. Even so, a Student always runs the risk of receiving an injury during a yoga class. By participating in a yoga class at YogaFest Studio, the Student accepts this risk of an injury. YogaFest Studio provides the following guidelines for reducing the risk of an injury:
      1. Always consult a doctor before starting yoga classes if you are not sure that you are completely healthy or if you are pregnant.
      2. If you have an injury or any other physical inconvenience, always inform your yoga teacher about this before starting the yoga class.
      3. Listen to and follow the instructions of the relevant yoga teacher.
      4. Perform the yoga exercises carefully and bear your physical limitations in mind.
      5. Do not perform any yoga exercises that are painful.
      6. Ask questions if you do not understand an exercise.
      7. Avoid inverted poses during menstruation.
    3. Although we strive to only provide correct information on our website, we are not liable for any inaccuracy and no rights can be derived therefrom.

 

  1. Personal Data
    1. YogaFest Studio collects personal data of the Students to update its membership records, to execute payment orders and for administration and information purposes. YogaFest Studio handles this collection of personal data with due care and complies with the provisions of the Dutch Data Protection Act.
    2. YogaFest Studio uses the personal data referred to in Clause 9.1 to inform the Students about activities of YogaFest Studio and any changes in the schedule, for example. If the Student does not want to receive communications from YogaFest Studio, he or she may communicate this to YogaFest Studio by sending an e-mail to studio@yogafeststudio.com. The Student is aware (s)he cannot use all online services and products of YogaFest Studio in that case.
    3. YogaFest Studio never gives any personal data of the Students to third parties without their prior written consent.

 

  1. Governing Law and Dispute Settlement
    1. The General Terms and Conditions are exclusively governed by Dutch law.
    2. Any disputes relating to the General Terms and Conditions, any Membership, an Introduction Offer, a 10 Class Pass, a Private Card or a Student’s attending group and private yoga classes, Workshops or Intensives organized by YogaFest Studio are settled exclusively by the competent court in Amsterdam or any higher court.

 

  1. ADDITIONAL GENERAL TERMS AND CONDITIONS FOR THE WORKSHOPS AND INTENSIVES OF YOGAFEST STUDIO
  2. Applicability of Additional Terms and Conditions and Definitions
    1. Intensives and Workshops are governed by these Additional Terms and Conditions in addition to the General Terms and Conditions. The General Terms and Conditions form an integral part of these Additional General Terms and Conditions. By participating in a Workshop or Intensive, the relevant Participant accepts the applicability of the General Terms and Conditions and the Additional General Terms and Conditions.
    2. In these Additional General Terms and Conditions, the following definitions apply.

 

  1. Participant: the person who attends or wants to attend a Workshop or Intensive.
  2. Price: the total price of a Workshop, including the deposit.

 

  1. Participation in Workshops and/or Retreats and Registration Fee
    1. A Participant may participate in a Workshop or Intensive after he or she has registered for it with YogaFest Studio in advance and paid the Registration fee or the Price. Registration may be effected by sending an email to studio@yogafeststudio.com. A place in the Workshop or Intensive is guaranteed after YogaFest Studio has received payment of the registration fee or deposit.
    2. For some Workshops and Retreats, an “Early Bird Rate” applies. This reduced rate applies until the date specified on the Website. After this date the normal rate, which is also specified on the Website, applies without exception.

 

  1. Payments
    1. Payments for a Workshop must be made before the Workshop is held. Payments can be made by direct debit, PIN or Credit Card (Master of Visa Card).

 

 

  1. Cancellation of Workshop Registration
    1. If the Participant cancels his or her registration, the payment is not refunded.
    2. In the event of prolonged illness or an injury, the Student may cancel the workshop. A request for cancellation must be submitted to YogaFest Studio in writing and must be accompanied by a medical certificate. This termination may be sent by email to studio@yogafeststudio.com.
    3. YogaFest Studio reserves the right to cancel the Workshop if there are insufficient participants. In this case, the registration fee already paid by the Participants is refunded immediately.

 

  1. Workshop Schedule
    1. The current Workshop Schedule can always be found on the Website. YogaFest Studio reserves the right to change the schedule at any time. If possible, any changes are announced in advance by mentioning them on the Website or by email.
    2. YogaFest Studio reserves the right to cancel a scheduled Workshop in the event of force majeure (including illness of the relevant teacher). In this case, the registration fee already paid is refunded.

 

  1. ADDITIONAL GENERAL TERMS AND CONDITIONS FOR SALES

RETURNS AND EXCHANGES

  1. You are always entitled to return your items with the receipt within 7 days from the time of purchase. Returns are free of charge.
  2. For the return to be accepted the returned items must be essentially in the same condition in which they were sold and with any seals intact. This does not apply if the items were damaged or otherwise changed due to any measure necessary to examine them, or due to any other circumstance not related to the consumer.
  3. No money refund; credit will be returned on your YogaFest account and can be used for products in the shop, yoga classes, but not for payments in the restaurant.
  4. Supplements, or other food items can not be returned.
